About these terms
These terms apply to tree work and associated services carried out by N & J Tree Services Limited (the “Contractor”). The person or organisation instructing the work is the “Client”. By accepting our quotation, the Client accepts the quotation and these terms, which together form the contract.
Nothing in these terms limits any rights or remedies that cannot lawfully be excluded, including a consumer's statutory rights.
Quotations and estimates
Unless stated otherwise, a quotation or estimate is valid for 90 days. It takes account of any monetary or other value that timber, woodchip or other arisings may have.
Work standards and measurements
Where reasonably practicable, tree work will be carried out in accordance with the current edition of British Standard BS 3998, Tree Work – Recommendations, unless the quotation states otherwise. Dimensions are approximate and pruning cuts will be made to the nearest appropriate pruning point wherever possible.
Changes to the work
The price or programme may need to change if:
- the required work is amended before we arrive on site;
- site or ground conditions have changed since our original visit; or
- additional work is requested or becomes necessary while we are on site.
Any variation will be agreed with the Client and recorded in writing, either electronically before the work or as a written variation on the day.
Cancellation and the cooling-off period
A Client acting as a consumer may have a legal right to cancel a distance or off-premises service contract within 14 days of the contract being made. Where that right applies, cancellation instructions and the required information will be provided with the quotation or contract.
If the Client expressly asks us to begin work during the cancellation period and later cancels, the Client may be required to pay a proportionate amount for the service supplied up to cancellation. If the service has been fully performed after the Client's express request and acknowledgement, the right to cancel may end.
Where the statutory cooling-off right does not apply, any cancellation charge will be fair and limited to reasonable losses and costs directly resulting from the cancellation. Cancellation should be sent in writing using the contact details on the quotation.
Permissions and authority
The Client confirms that they own the trees or have authority from the owner to instruct the work. Before work starts, the Client must tell us about any Tree Preservation Order, conservation area status, planning condition, restrictive covenant or other known restriction affecting the trees or site.
The Client and Contractor must ensure that all permissions required for the work are in place. These may include consent from the local planning authority, a felling licence from the Forestry Commission, and permissions or consultations involving Natural England, the Environment Agency or another relevant body. We may delay or decline work until satisfactory evidence of permission is available.
Work to third-party trees
Where work is proposed to a tree owned by a third party, we may require written confirmation from the tree owner that the work and any necessary access are agreed. Permission from the tree owner is not normally required to prune overhanging branches from within the Client's boundary, but the neighbour should be informed where practicable. The work must not make the tree unsafe, trespass beyond the boundary or breach any statutory protection.
Stump grinding and underground services
Unless the quotation states otherwise, stump grinding will be carried out to approximately 200mm below the immediately adjacent ground level. It includes the stump and buttress roots but not lateral roots.
Before work starts, the Client must identify any known underground services near the stump or work area and provide current service plans or statutory undertaker records where required. The scope or price may change if unidentified services, obstructions or unsafe ground conditions are found.
Arisings
Unless the quotation states otherwise, all arisings—including twigs, branches, woodchip, logs, trunks and foliage—will be removed from site and become the property of the Contractor.
Programme, ecology and wildlife
We will make reasonable efforts to carry out the work on the agreed date, but work may be delayed, changed or stopped because of unsafe weather, site conditions, access restrictions, emergencies or legal and ecological constraints.
Relevant legislation includes, as amended:
- the Wildlife and Countryside Act 1981;
- the Countryside and Rights of Way Act 2000; and
- the Conservation of Habitats and Species Regulations 2017.
We will assess the work's potential impact. Nesting birds, roosting bats or other protected species may require the work to be delayed, changed or referred for specialist advice or licensing.
Health, safety and site access
We will follow good industry practice, our health and safety procedures and a site-specific risk assessment. Exclusion zones or other controls may restrict the Client's, occupants' or visitors' access to parts of the site while work is in progress. Access to those areas must be agreed with our site team.
Where work continues over more than one day, the site will be left appropriately secure and safe at the end of each working day, as agreed with the Client.
Site condition after the work
We will leave the site generally clean, tidy and safe. Tree work naturally produces wood dust, sawdust, woodchip, twigs, leaves and needles, and involves the movement of people and machinery, so the site may not be in exactly the same condition as it was before work began.
Invoices, payment and concerns
An invoice will be issued when the work is complete. Payment is due within 30 days unless the quotation or invoice states that payment is due in full on completion or sets another agreed period.
If the Client believes the work is incomplete or unsatisfactory, they should tell us in writing as soon as reasonably possible—preferably within 48 hours—so that we can inspect and respond. This request does not affect a consumer's statutory rights.
Insurance
The Contractor holds £5 million public liability insurance. A copy of the current certificate is available on request.
Personal information
We handle personal information in accordance with UK data protection law. Details of what we collect, why we use it and the choices available are set out in our privacy policy. We will not use an enquiry to send promotional electronic marketing unless there is an appropriate lawful basis and the required choice or permission has been provided.
